ATTORNEY GENERAL RAOUL LEADS COALITION OPPOSING TRUMP ADMINISTRATION’S ROLLBACK OF COMMONSENSE FIREARMS REGULATIONS

Chicago – Attorney General Kwame Raoul has led a coalition of 23 attorneys general warning that the Trump administration’s rollback of commonsense firearms regulations will endanger their communities, many of which – like Chicago – have seen levels of gun violence drop dramatically in recent years. In May, the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) announced the “most comprehensive regulatory reform package in the history of ATF,” splitting its broad deregulatory effort into 34 different rule-making notices. As Raoul and the coalition show in their comment letters responding to this barrage, the so-called “reform package” unlawfully abdicates ATF’s responsibility to implement federal laws passed to keep the public safe. Raoul and the coalition argue that, in advancing these changes, the ATF is unlawfully walking away from its core duty to protect the public and faithfully carry out the laws Congress enacted. Although the ATF’s notices say that none of these rules were drafted directly or indirectly by any member of the gun industry, its promotional materials and the gun industry associations themselves say otherwise, announcing it as an effort in “partnership with the gun industry,” even as the industry stands to profit from these changes at the expense of public safety.“With these proposals, the Trump administration is attempting to abandon a plethora of federal firearm safety rules, many of which were bipartisan, have been in effect for decades and have been proven to reduce gun violence,” Raoul said. “I am joining my fellow attorneys general to alert the public to the seriousness of this concerted and dangerous effort to significantly weaken our public safety laws, which would only lead to increased gun violence across the nation while hampering law enforcement efforts to trace crime guns.” In a series of comment letters submitted between July 6 and August 6, Raoul and the multistate coalition outline the damage to public safety that will ensue if these massive deregulatory changes take effect, and the coalition urges the ATF to abandon or revise many of these proposals. As detailed in the letters, the harmful proposals by the ATF would undo years of bipartisan progress aimed at reducing gun violence. To one degree or another, the proposals violate various federal laws, exceed the ATF’s authority, violate congressional intent and are contrary to past Supreme Court rulings. Many are offered without evidence or explanation, without required consultations with the states, and were subject to undue and undisclosed industry influence. If enacted, the proposed rules would:

ATTORNEY GENERAL RAOUL SECURES ORDER PROTECTING FEDERAL SUPPORT FOR HOMELESSNESS SERVICES

Chicago – Attorney General Kwame Raoul, as part of a coalition of 20 attorneys general and two state governors, announced a win in their second lawsuit challenging the U.S. Department of Housing and Urban Development’s (HUD) illegal attempt to cap funding for permanent housing projects to address homelessness in states. On Friday, a judge with the U.S. District Court for the District of Rhode Island granted critical parts of Raoul and the coalition’s motion for summary judgment, ruling that HUD’s set-aside was unlawful and cannot be implemented.“This order ensures states continue to have access to funding that is necessary to address homelessness,” Raoul said. “These resources were appropriated by Congress, and the attempt by the Trump administration to take away these funds is illegal and outside of HUD’s authority. I will continue to take action to protect federal funding for Illinois and stand with my colleagues in defense of the rule of law.” For more than two decades, HUD has embraced a commitment to permanent housing programs and the Housing First model, which prioritizes getting unhoused individuals and families into permanent housing without pre-conditions, such as sobriety or a minimum income threshold. Housing First is proven to be effective at addressing homelessness and has been the cornerstone of state efforts since HUD and the Continuum of Care program first embraced the model over two decades ago. But the current federal administration has rejected HUD’s longstanding commitment to the Housing First model and undermined the Continuum of Care program.HUD first published notices of funding opportunities last year that cut funding for permanent supportive housing by 70%. That funding opportunity was subsequently found to be unlawful in a separate lawsuit against HUD that Raoul and the coalition won on June 30 regarding the agency’s decision to impose illegal conditions on billions of dollars in funding for the Continuum of Care program. The program supports housing and other services for people experiencing housing instability or homelessness. On June 1, HUD issued a notice of funding opportunity that creates a $1.3 billion set-aside for new projects prioritizing such things as transitional housing, which has the effect of limiting available Continuum of Care funding for permanent housing. That new funding opportunity, which is the subject of the current lawsuit, threatened housing for at least 97,000 residents of Continuum of Care-funded permanent housing across the country and more than 5,000 residents in Illinois alone, according to the National Alliance to End Homelessness.Joining Raoul in filing this lawsuit are the attorneys general of Arizona, California, Colorado, Connecticut, the District of Columbia, Delaware, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Virginia, Washington and Wisconsin, and the governors of Kentucky and Pennsylvania.

ATTORNEY GENERAL RAOUL DEFENDS STATE COURTS’ ROLE IN CLIMATE CASE BEFORE U.S. SUPREME COURT

Chicago – Attorney General Kwame Raoul today joined a multistate state coalition of 16 attorneys general in filing a court brief in the U.S. Supreme Court in Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County, urging the court to follow longstanding jurisdictional rules and preserve the role of state courts in resolving state common-law claims. The case stems from a lawsuit filed by Boulder County and the city of Boulder, Colorado against several fossil fuel companies seeking damages for alleged harms related to climate change. The companies asked the Supreme Court to review the case before Colorado’s courts have finished considering it. In addition to agreeing to hear the appeal, the Supreme Court directed the parties to address whether it has the authority to hear the case at this stage of the litigation.“For decades, state and local governments have had access to state courts to seek justice on behalf of the people they represent,” Raoul said. “I am proud to join my colleagues in urging the Supreme Court to preserve that right.” Raoul and the coalition argue in their brief that the court's decision could affect far more than this case. States across the country rely on their courts to decide a range of state common-law claims. Raoul and the coalition warn that allowing federal courts to intervene before state court proceedings are complete and decided on their merits would impact a range of cases well beyond the climate litigation brought here.Raoul and the coalition’s brief further explains that states should not lose their authority to apply state law simply because a case involves issues that cross state lines. The attorneys general say the Constitution does not automatically prevent states from hearing these claims. Finally, Raoul and the coalition note that state courts already have well-established legal rules for determining whether claims should proceed. Those decisions, the attorneys general say, should be made through the normal judicial process rather than through a broad new federal rule that prevents state law claims from proceeding in state courts.Joining Raoul in filing the brief are the attorneys general of Arizona, California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Maine, Massachusetts, Michigan, Nevada, New Jersey, New York, Rhode Island and Washington.

ATTORNEY GENERAL RAOUL ANNOUNCES SETTLEMENT WITH MAKERS OF POSH E-CIGARETTES

Chicago – Attorney General Kwame Raoul today announced a settlement with the entities responsible for distributing Posh, one of Illinois’ bestselling disposable vape brands. The settlement resolves allegations the entities violated the Illinois Youth Prevention Vaping Act by selling unauthorized flavored e-cigarettes and marketing those products in ways that are attractive to youth. “Today’s settlement ensures one of the most prolific vaping brands in Illinois will no longer sell unauthorized e-cigarettes with flavors that appeal to youth,” Raoul said. “I remain committed to working to protect our communities from the harms of illegal and unregulated e-cigarettes and will continue to hold companies accountable for targeting youth with their addictive products.”Raoul filed a lawsuit in January 2025 as part of a coordinated, bipartisan nationwide effort to hold companies accountable for unlawfully manufacturing, distributing, selling and marketing flavored disposable e-cigarette products. Raoul’s lawsuit alleged that Posh products are not lawful for sale in Illinois under the Youth Prevention Vaping Act, which prohibits the sale of e-cigarettes unless they have been approved by the Food and Drug Administration (FDA) for marketing and sale in the U.S. The lawsuit also highlighted that the company marketed their products in countless fruit and candy flavors like Gummy Bear Ice, Ice Cream Cone and Jelly Berry on social media platforms popular with youth, such as Instagram, using imagery and themes attractive to young people. The settlement requires the defendants to pay $20 million that will allow for the continued enforcement of state law protecting Illinoisans, including against illicit vaping entities. In addition, the entities are prohibited from selling, distributing or advertising Posh e-cigarettes in Illinois unless and until their products obtain a marketing-granted order from the FDA. Every new tobacco product, including e-cigarettes, must receive an order from the FDA authorizing its marketing and sale in the U.S.The entities are also prohibited from advertising or marketing any e-cigarette in a way that is attractive to youth – specifically by using any cartoons, social media influencers or any model under the age of 35 – and must use all platform-provided age gating tools on any social media accounts where e-cigarettes are advertised or marketed.Today’s settlement announcement is part of Attorney General Raoul’s ongoing work to combat youth e-cigarette use and hold e-cigarette manufacturers accountable for epidemic usage levels among youth and teens. After Raoul and a bipartisan coalition of 25 attorneys general urged Shopify Inc. to take stronger action against merchants that use its services to sell illegal tobacco products, Shopify announced a ban on the sale of all vaping products – including e-cigarettes – in June.In May, Raoul and a bipartisan coalition called upon the FDA to abandon draft guidance that would ease approvals for flavored e-cigarette products, widely understood to disproportionately worsen youth addiction. In April, Raoul joined a bipartisan coalition urging major credit card companies and payment processors to take stronger action to prevent their payment networks from being used to facilitate sales of illegal vaping products. For more information and free resources to help quit tobacco, please visit the Illinois Tobacco Quitline website or call 1-866-QUIT-YES.
